During probate, a Petition is filed with the court asking the court to appoint a Personal Representative. The Personal Representative will be required to file with the court the following information:
The Personal Representative is required to provide a notice to all known persons who may possibly be interested in the estate, and to further publish a notice to creditors in a local newspaper. The Personal Representative is responsible for paying the decedent's creditors, and filing all necessary tax returns. After receiving permission from the court, the Personal Representative then distributes the assets of the estate to the proper parties. The Personal Representative's attorney's fees are paid at the conclusion of the probate from the assets of the estate.
Melissa Garrison handles Wills and Trusts. She has been an attorney for 19 years, and has a total of 30 years in the legal field. A popular and sought-after speaker, she has addressed a number of local groups, including Mercy Corps and the Small Business Development Center, regarding family and business legal issues, and has been a Contracts and Legal Research Instructor at the College of Legal Arts in Portland. Melissa graduated from the University of San Francisco, School of Law. This included study at Trinity College, Dublin, Ireland, under Ireland’s then-President, future United Nations’ High Commissioner for Human Rights, and Medal of Freedom recipient, Mary Robinson. Melissa is a member of both the Oregon State Bar and the California State Bar. She obtained her undergraduate degree from the University of California, Santa Cruz with a major in Literature.
